Terms of Service

1. Agreement to Terms

By accessing or using Pictify ("the Service", "we", "us", or "our"), you ("User", "Studio", or "Subscriber") agree to be bound by these Terms of Service. If you do not agree to these terms, you must immediately cease all access and use of the platform.

2. Account Registration & Security

To access the platform, you must create a studio account. You are solely responsible for maintaining the confidentiality of your account credentials, API keys, and access tokens. You agree to accept full responsibility for all activities, uploads, and automated API interactions that occur under your account.

3. Subscriptions, Billing & Founder Guarantees

• Billing Cycle: Subscriptions are billed in advance on a recurring monthly or annual basis via Stripe.
• Beta & Promotional Pricing: Discount codes (e.g., BETA50) apply to the initial designated billing period (e.g., 3 months). After the promotional period, standard rates or locked-in Founder discounts apply as outlined in your billing portal.
• Cancellation & Grace Period: You may cancel your subscription at any time via your dashboard. Unpaid or cancelled accounts enter a 30-day grace period. After 30 days, unrenewed storage, media assets, and facial indexing indices may be permanently deleted.
• Refund Policy: Due to continuous cloud infrastructure, AI worker compute, and NVMe S3 resource allocation, payments are non-refundable except where explicitly required by UK law.

4. Acceptable Use & Storage Limits

You agree not to misuse the Service or assist anyone else in doing so. Specifically, you agree NOT to:

• Upload, host, or distribute material that is unlawful, defamatory, harassing, or infringes on third-party intellectual property or privacy rights.
• Upload non-photographic data dumps, illegal software, or automated scripts intended to exhaust server compute, NVMe storage pools, or worker queue resources.
• Attempt to reverse-engineer, probe, or bypass security mechanisms, custom domain SSL provisioning, or tenant isolation layers.

We reserve the right to suspend accounts or terminate galleries that exceed unreasonable compute thresholds or violate acceptable content boundaries.

5. Biometric Facial Search & GDPR Compliance

Pictify provides an optional "Find My Face" AI search engine powered by AWS Rekognition. When using facial search:

• Non-Persistent Matching: Guest selfies uploaded for gallery matching are processed ephemeral in memory and are never stored in a permanent facial database.
• Consent Workflows: Studios are responsible for ensuring appropriate guest consent controls (e.g., opting in prior to facial scanning) in accordance with applicable local laws (including GDPR and biometric privacy acts).
• Tenant Isolation: Facial indices generated for your galleries are strictly isolated to your studio and are never shared across other accounts or public AI models.

6. Intellectual Property & Content Ownership

You retain 100% full ownership of all high-resolution photos, videos, logos, watermarks, and media files uploaded to Pictify. We claim no ownership or copyright over your content. You grant us a non-exclusive, worldwide license solely to host, transcode, stream, and display your media as necessary to operate the Service on your behalf.

7. Service Level & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for 99.9% uptime and utilize redundant high-speed S3 storage and isolated background worker pipelines, Pictify shall not be held liable for any indirect, incidental, or consequential damages, loss of business revenue, or data loss resulting from service interruptions or third-party cloud outage events.

8. Governing Law & Amendments

These Terms are governed by and construed in accordance with the laws of England and Wales. We reserve the right to modify these Terms at any time. Continued use of the platform following written or published notice of updates constitutes your binding acceptance of the modified Terms.
